GDPR and workplace AI: balancing safety monitoring with privacy rights

If you're evaluating computer vision AI for workplace safety, the privacy question will come up early. This is true even when the footage is processed by an algorithm rather than viewed by a person. For workplace safety monitoring, the most common legal basis is legitimate interests. Under Article 6(1)(f), an organisation can process personal data where it has a legitimate interest that isn't overridden by the rights and freedoms of the individuals concerned. Occupational health and safety, when supported by regulatory obligations like those under New Zealand's HSWA, Australia's WHS framework, or EU member state health and safety laws, provides a strong foundation for this basis. Compliance with a legal obligation (under Article 6(1)(c)) may also be relevant where workplace safety monitoring is required by law.

Under Article 35 of the GDPR, any processing that is likely to result in a high risk to individuals' rights and freedoms requires a Data Protection Impact Assessment (DPIA) before you begin. Systematic monitoring of a publicly accessible area, or of employees in a workplace, almost always triggers this requirement.


A DPIA isn't a formality. It's a structured exercise that forces you to document why you're processing the data, what alternatives you considered, how you'll minimise the impact on individuals, and what safeguards you'll put in place. For AI safety monitoring, the DPIA should cover the specific cameras being connected, the types of events being detected, how long event data is retained, who can access the data, whether the system identifies individuals, and how workers are informed about the monitoring.


Your AI platform vendor should be able to support your DPIA with clear documentation of their data flows, processing architecture, and security certifications. If a vendor can't explain where your data goes and who can access it, that's a significant red flag.




The EU AI Act: a new layer of regulation


The EU AI Act, which began taking effect in stages from August 2024, adds specific requirements for AI systems. Two provisions are particularly relevant to workplace safety monitoring.


First, the Act explicitly prohibits AI systems that infer emotions in workplaces, except where the use is intended for medical or safety reasons. This means computer vision AI designed to detect safety events (pedestrian-vehicle interactions, exclusion zone breaches, speed violations) falls outside the prohibition, but any system that attempts to assess workers' emotional states would be banned. The distinction matters: a safety platform should be detecting interactions and behaviours that create physical risk, not profiling individuals' psychological states.

Privacy by design: the architecture that makes it work


GDPR's Article 25 requires data protection by design and by default. For AI safety monitoring, this translates directly into architectural decisions about how the platform processes and stores data.


On-premise processing. Beyond the EU: privacy principles that apply everywhere


Even if your organisation doesn't operate in the EU, the principles underpinning GDPR are increasingly reflected in privacy frameworks worldwide.


In New Zealand, the Privacy Act 2020 establishes similar principles around purpose limitation, data minimisation, and transparency. While it doesn't require DPIAs in the same formal way as GDPR, the Office of the Privacy Commissioner recommends privacy impact assessments for new technologies that process personal information.


In Australia, the Privacy Act 1988 and the Australian Privacy Principles (APPs) impose comparable obligations around collection limitation, use and disclosure restrictions, and data security. The Australian Government has also been consulting on reforms that would strengthen privacy protections for employee monitoring.


In the United States, the landscape is more fragmented, with state-level laws like the California Consumer Privacy Act (CCPA) and Illinois Biometric Information Privacy Act (BIPA) imposing specific obligations that may apply depending on where your workforce is located.


The common thread across all jurisdictions is proportionality. Whatever privacy framework applies, you need to demonstrate that your monitoring is proportionate to the safety purpose, that you're collecting only what's necessary, and that you've implemented appropriate safeguards.




Practical steps for deploying AI safety monitoring under GDPR


If you're preparing to deploy a computer vision AI safety platform in a GDPR-regulated environment, here's a practical framework.


Conduct a DPIA before deployment. Document the purpose (occupational health and safety), the legal basis (legitimate interests or legal obligation), the types of data processed, the retention periods, the safeguards in place, and the risks to individuals. Your vendor should provide supporting documentation.


Inform your workforce transparently. Under Articles 13 and 14 of GDPR, individuals must be informed about the processing of their data. This means clear signage in monitored areas, a detailed privacy notice explaining what the system does and why, and (where applicable) consultation with workers' representatives or unions before deployment. Transparency is also the single most effective way to build workforce trust in the technology.


Choose an architecture that minimises data exposure. On-premise processing, automatic anonymisation, and role-based access controls aren't optional extras. They're the architectural decisions that make the difference between a system that's designed for compliance and one that creates compliance risk.


Review your vendor's security certifications. SOC 2 Type II, ISO 27001, and GDPR compliance should be independently verified, not self-declared. These certifications demonstrate that the vendor has built security into their operations and that an independent auditor has confirmed it.


Define and enforce retention policies. Set clear retention periods for event data and coaching clips. Ensure the system automatically purges data beyond those periods. Document your rationale for the retention periods you've chosen.


Establish human oversight. The EU AI Act will require human oversight for high-risk AI systems in employment contexts. Even before those obligations take effect, establishing clear human review processes for how AI-detected events are used (particularly in coaching and investigation contexts) is both good practice and a demonstration of responsible deployment.

The tension between workplace safety monitoring and worker privacy is real but not irreconcilable.
